Hispanics in Mining (hereinafter, “HIM”, “HispanoMine”, “we”, “us” or “our”) is committed to protecting your privacy, and support a general policy of openness about how we collect, use and disclose your Personal Information (as defined below).

1.   Purpose

The purpose of this Privacy Policy is to inform you about HIM practices relating to the collection, use and disclosure of Personal Information that may be provided through access to or use of our website or services (if applicable), or that may otherwise be collected by us by means of subscription to HIM’s emailing list or newsletter, event registration forms or surveys. By using HIM’s website (“Website”), responding to HIM’s correspondence or event registration forms you consent to the collection, use and disclosure of your Personal Information in accordance with the terms of this Privacy Policy. If you do not agree with the terms of this privacy policy, please discontinue your use of our Website.


2.   Personal Information we collect

For the purpose of this Privacy Policy, “Personal Information” means information about you that is personally identifiable. We may collect your Personal Information during your dealings with us or while you visit our Website, for example when you request information about our organization, register for an event, contact us by e-mail or phone, or subscribe to our updates, newsletters, or emailing list. The type of information we may collect and process includes but is not limited to:


(a)    Your names, surnames, gender, personal and work contact details (such as address, phone number, e-mail address), business title;

(b)    Information, feedback or content you provide regarding your interests or marketing preferences in our email sign up form or surveys;

(c)    Information that your web browser sends whenever you visit our Website (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our website that you visit, the time and date of your visit, the time spent on those pages and other statistics.


3.   How we may use, collect or disclose your Personal Information

We may use, collect or disclose your Personal Information to:


(a)  register you in our events and manage our guest lists provided you have filled out our registration form;

(b)  communicate about, and administer your participation in, events, programs, surveys, subject to your consent;

(c)   verify your identity and prevent fraud;

(d)  administer general record keeping;

(e)  bill you for our events and services and collect payment;

(f)    meet legal and regulatory requirements;

(g)  send you our newsletters and information that may be of interest to you, subject to your consent;

(h)  develop and maintain our relationship with you and communicate with you;

(i)    perform data analyses and conduct other research (such as market and user research and trend analysis) to develop, manage, protect and improve our Website, and business (including analyzing the effectiveness of our marketing and advertising).

If you have subscribed to HIM’s emailing list or newsletters, we may also use (but will not disclose) your Personal Information to contact or send you relevant information based on your subscription preferences. You may unsubscribe at any time by clicking the unsubscribe link embedded at the HIM’s email communications.


4.   When we may disclose your Personal Information

We will not transfer or assign in any form your Personal Information to or with third parties without your consent. From time to time, we may disclose your Personal Information as set out below. We would always make that disclosure as permitted by law. When you agree to this Privacy Policy, you are, to the extent permitted by law, granting your consent to the transfer of your Personal Information to third parties for the purposes set out in this Privacy Policy and to the extent stated in this section and as described in section 3 above. These third parties may not process or otherwise use your Personal Information, except in accordance with this Privacy Policy and as permitted by law.

(b)    We reserve the right to disclose Personal Information to a third party if a law, regulation, court order, search warrant, or subpoena legally requires or authorizes us to do so. We also reserve the right to retain Personal Information collected and to process such Personal Information to comply with accounting and tax rules and regulations and any specific record retention laws.

(c)    If HIM is involved in a business reorganization included but not limited to merger or acquisition, your Personal Information may be transferred. We will make reasonable efforts to provide notice before any Personal Information is transferred and becomes subject to a different Privacy Policy.


5.   How we protect, retain and maintain your Personal Information

HIM makes commercially reasonable efforts to ensure that your Personal Information is protected against loss, theft and unauthorized access, disclosure, copying, use, or modification. This protection applies in relation to information stored in both electronic and hard copy form. Access to your Personal Information is restricted to selected personnel. In addition, we are committed to ensuring the security of your Personal Information and may use passwords, encryption, firewalls, restricted employee access or other methods, in our discretion. We will use appropriate security measures when destroying your Personal Information such as shredding documents or deleting electronically stored information, in our discretion.


HIM retains your Personal Information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws, and your consent to such purposes(s) remains valid after termination of our relationship with you. For the purposes set out in this Privacy Policy, we or an unaffiliated service provider may process and store your Personal Information outside of the province in which you reside and/or outside of Canada, and under the laws of those other jurisdictions. If you are located outside Canada and choose to provide information to us, please note that we transfer the information, including Personal Information, to Canada and process it here. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.


We will make reasonable efforts to ensure that your Personal Information is accurate and complete. A request must be in writing and provide sufficient detail to identify your Personal Information and the correction being sought.

HIM collects Personal Information about you only when you voluntarily provide it. You may always choose what Personal Information (if any) you wish to provide to us. However, if you choose not to provide certain details, some of your experiences with us may be affected (for example, we cannot register you to an event without a name).


We will not, as a condition of the supply of a service, require you to consent to the collection, use or disclosure of information beyond that required to fulfill the explicitly specified and legitimate purposes for which the information is being provided.


We will seek consent for the use or disclosure of your Personal Information at the time of collection. You can provide consent orally, in writing, electronically or through an authorized representative. In certain circumstances, consent may be sought after the information has been collected but before use (for example, when we want to use information for a purpose not previously identified, when is required by law or in an emergency situation that threatens an individual’s life, health or personal security). Our website does not address users under the age of 18 (“Minors”). We do not knowingly collect Personal Information from Minors.
